AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Pharmaesthetics (“we,” “us” or “our”), concerning your access to and use of the https://pharmaestheticscentral.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms and Conditions, and you waive any right to receive specific notice of each such change.

It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Site after the date such revised Terms and Conditions are posted.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

These Terms are governed by the laws of England and Wales and any dispute, question or remedy shall be determined exclusively by the courts of England and Wales.

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use the Site.

OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS

Ownership of this Site and associated Intellectual Property Rights is our proprietary property and retained by us. However, all source code, databases, functionality, software, website designs and graphics on the Site are owned or controlled by or licensed to Digitalpharm LTD. Some content, such as video, text, photographs, and logos contained therein (the “Marks”) are a mixture of content by us and by Digitalpharm LTD – all of which are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United Kingdom, foreign jurisdictions, and international conventions.

The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms and Conditions, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without express prior written permission by us or Digitalpharm LTD.

All material on this Site is our copyright unless expressly stated otherwise. Unauthorized use is strictly prohibited.

Prohibition on the use of trademarks without prior written permission.

Notice circumvention, deletion, or adjustment is strictly prohibited.

No legal rights granted except those essential for Site access.

USAGE OF THIS SITE

Pharmaesthetics Central is solely intended for non-commercial personal use.

When you sign up to our website or make any purchase on our site, you are legally bound to:

  1. All our terms and conditions and any related documents.
  2. Any additional terms and conditions that may supersede or augment this agreement due to regulatory, legal changes, or security considerations.
  3. Terms specifically applicable to certain products or treatments.

When using this Site you acknowledge sole responsibility for:

  1. All costs or expenses incurred in using our site.
  2. Safeguarding the confidentiality of your passwords and other account information.

This website operates within the jurisdiction of the UK. If accessing from outside the UK, compliance with local laws is your responsibility.

Non-compliance with these terms and conditions allows us to suspend and restrict your access to our site.

WARRANTIES

You warranty that you give truthful and honest disclosure in the online consultation is mandatory. Untruthful answers void the agreement and risks your health and wellbeing.

We warranty that we maintain confidentiality and proper handling of your information.

PAYMENTS

All major debit/credit cards are accepted by us.

All payments made to us are via secure payment with encrypted gateway and cards are only charged after the completion of checkout by you.

All payments to us undergo authorisation checks by our payment provider.

All prices on our website are displayed in GBP (£) and where applicable inclusive of VAT but exclude delivery costs.

Making a payment does not guarantee treatment approval which is assessed by our independent prescriber pharmacist to determine suitability. If your treatment is declined you will be eligible for a full refund to the original payment method.

We must receive full payment in advance before your order can be processed and the goods can be dispatched.

ORDERING

We are a private distance selling pharmacy.

Prior to ordering, you are required to sign up to our website and all the associated terms and conditions.

Upon submission of all required documents, consents and medical questionnaire to our prescriber your order is completed which is only an acknowledgement of receipt of your order. This does not confirm prescriber authorisation. Your order will only be authorised and confirmed once our prescriber has reviewed and completed your consultation. (Additional contact may be required for various reasons, e.g. payment issues, referral to GP, additional information). Once your order is completed and dispatched only then shall a binding contract be formed.

Once you use our services, your prescriptions are sent to us either in paper or electronically and we deliver them to you via the most appropriate courier method. We will keep you updated about the progress of your prescription and the expected delivery time.

We will not be able to dispense medication unless we are in possession of a valid private prescription (either electronic or paper).

You agree that the pharmacist or pharmacy technician responsible for your order can access your GP Health Records if clinical and/or safety information is required and deemed appropriate to improve your care.

We do not take responsibility for paper prescriptions sent to us that become lost in the post.

Occasionally substitution may be required if the requested medication is unavailable. You will be contacted prior in these events to discuss further.

Packaging may differ from those shown on the website.

SUPPLYING MEDICATION

Once we receive your prescription, we aim to dispense medication within one or two days. Once our trained staff have dispensed your medication, our qualified pharmacists will clinically check your prescription and medication following which it will be packaged for delivery dispatch.

We give access to an online consultation with a qualified UK GPhC registered Independent Pharmacist Prescriber. Undertaking a consultation and purchasing treatment are subject to the terms and conditions herein.

Sharing information with your GP or other healthcare professional requires your express consent (an essential requirement of using Pharmaesthetics Central) which you agree to when using this website and agreeing the terms and conditions when you signup or place an order.

Any medication prescribed is dispensed by a UK GPhC registered pharmacist, in accordance with the written prescription.

RESPONSIBILITIES

You are responsible for complying with these Terms and conditions.

We are responsible for ensuring that your prescriptions are dispensed correctly and in accordance with General Pharmaceutical Council standards and guidelines, and these terms and conditions. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation. The material displayed on our site (which includes the blog on the site) is provided without any guarantees, conditions or warranties as to its accuracy.

You have certain legal rights. Nothing in these terms and conditions is intended to affect these legal rights or other rights to which you may also be entitled. You should always seek independent legal advice if you are in any way unsure about your legal rights or our obligations to you.

If we breach these terms and conditions then we shall only be liable for losses that are a reasonably foreseeable consequence of such a breach. Losses are foreseeable where they could be contemplated by you as relevant at the time of entering these terms and conditions. We do not accept liability for matters outside of our control, such as acts of terror or acts of God or where you provide false information.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • Your use of, or inability to use our site; or
  • Your use of or reliance on any content displayed on our site.

In particular, we will not be liable for any indirect or consequential loss or damage.

Please note that we only provide our site for use by patients accessing our private services. You agree not to use our site for any commercial or business purposes.

WHAT YOU NEED TO DO

Our site and any services provided via the site will be in English and it will be your responsibility to ensure that you fully understand the information and advice on our site.

You, the account holder or patient orderer, are responsible for the information you provide to us about yourself, your GP, your medical history and your medication; and any information given on behalf of someone else as their proxy.

You confirm that all information provided to us is and remains accurate throughout.

If you fail to provide accurate information you could be putting yourself or the person you are managing medication for at serious risk of harm.

You are responsible for checking and taking any medication correctly. You must check the spelling and dosage information and follow the clinical directions provided with all medication. You should read and review the patient information leaflet provided with the medication. If at any point the information that appears from us contradicts the information provided by your prescriber, please contact us immediately. You agree that the information provided by your GP or other healthcare professional and in the patient information leaflet take precedence over any information provided by us.

You confirm that you are requesting medications for only your own personal use or for the use of someone for whom you are acting as a proxy for. Medications should never be shared with any other person in any circumstance.

You agree to keep your Pharmaesthetics Central login details confidential and not to share them with any other person.

You agree not to use any service provided by us for any unlawful purpose, including requesting medications that have not been prescribed to you or the person you are managing medication for by a registered healthcare professional.

DISPOSAL OF MEDICATION

Once dispensed, you will be unable to cancel the order, return the medication or receive a refund. Any unwanted medicines must be disposed of by returning the medication to a local pharmacy.

DELIVERY

Any Prescription must be approved by a prescriber before it can be dispensed and delivered to you. We deliver your medication by Royal Mail or DPD in discreet, unmarked packaging. For your safety, all deliveries are sent via tracked service that require signature for proof of delivery. Refrigerated items are delivered in temperature controlled packaging, that keep the temperature of medication within the package regulated between 2°C and  8 °C.

Please allow 2 to 3 days for all deliveries. We are unable to change addresses once an order has been placed. We only deliver to UK addresses. Unfortunately, we are unable to send medication outside the UK. If you require an item urgently, we may be able to send it by Royal Mail Special Delivery, but there may be an additional charge. Please contact us for further details. You must be home to accept delivery after placing an order. We cannot replace or refund medicines which were not delivered or delayed due to a missed delivery. Our liability terminates upon proof of delivery by the courier to the address specified by you at time of order.

We recommend only placing orders to a premises where only you or your trusted contacts have access. By opting to have a parcel delivered to a multi-occupancy building, office, commercial property, or any other shared property, you assume responsibility for any parcel that is reported as missing after it has been delivered to the specified premises. When you opt to have medication delivered, you agree to ensure that it is safe for items be delivered to your chosen delivery address, particularly with regards to safeguarding children or pets.

When you signup to our website and place an order you accept our Delivery and Returns Policy.

RIGHT TO CANCEL – Regulation 28 specifies the exception to the right to cancel for medicines.

Due to the nature of the services and products sold, sales are non-refundable once the items have been dispatched from us. Cancellation are only applicable prior to dispatch. Once your order has been dispatched no refund is applicable.

For order cancelled in writing prior to dispatch a full refund will be provided.

When applicable a refund will be issued within 14 days of cancellation notice.

Contract termination does not waive outstanding monetary obligations.

USER REPRESENTATIONS

By using the Site, you represent and warrant that:

(1) all registration information you submit will be true, accurate, current, and complete;

(2) you will maintain the accuracy of such information and promptly update such registration information as necessary;

(3) you have the legal capacity and you agree to comply with these Terms and Conditions;

(4) you are not under the age of 18

(5) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise;

(6) you will not use the Site for any illegal or unauthorised purpose;

(7) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

THIRD-PARTY WEBSITES AND CONTENT

The Site may contain (or you may be sent via the Site) links to other websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (“Third-Party Content”).

Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content.

You should review the applicable terms and policies, including privacy and data gathering practices, of any website to which you navigate from the Site or relating to any applications you use or install from the Site. Any purchases you make through Third-Party Websites will be through other websites and from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party.

You agree and acknowledge that we do not endorse the products or services offered on Third-Party Websites and you shall hold us harmless from any harm caused by your purchase of such products or services. Additionally, you shall hold us harmless from any losses sustained by you or harm caused to you relating to or resulting in any way from any Third-Party Content or any contact with Third-Party Websites.

SITE MANAGEMENT

We reserve the right, but not the obligation, to:

(1) monitor the Site for violations of these Terms and Conditions;

(2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms and Conditions, including without limitation, reporting such user to law enforcement authorities;

(3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof;

(4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems;

(5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.

PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy posted on the Site. Please be advised the Site is hosted in the United Kingdom.

Website security is not guaranteed; avoid submitting confidential or valuable information. Unwanted Submissions may be used at our discretion, free of charge. Information disclosure to third parties is possible when permission given.

MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time.

We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors.

MISCELLANEOUS

These Terms and Conditions and any policies or operating rules posted by us on the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not operate as a waiver of such right or provision.

There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms and Conditions or use of the Site. You agree that these Terms and Conditions will not be construed against us by virtue of having drafted them.

You hereby waive any and all defences you may have based on the electronic form of these Terms and Conditions and the lack of signing by the parties hereto to execute these Terms and Conditions.

COMPLAINTS AND CONTACTING US

We at Pharmaesthetics Central are committed to delivering the highest standards of patient care. We are a patient orientated and friendly company and always happy to help. If there is something you are not happy about, we would like to know. Any feedback is relayed to the team and we can use this feedback to improve our services.

If you have a complaint, we would like to hear about it. In the first instance, you can directly contact our superintendent pharmacist who will investigate incidents inline with the procedures in place.
